GENERAL CONDITIONS

IT IS ESSENTIAL TO KNOW HOW TO SWIM

• The activities, being carried out in the natural environment and with different types of people, are subject to possible previous or on-site variations (physical condition of the participants, weather,… ) In case of cancellation of the activity by aloKAYAK , the client has the right to postpone it or to a refund of the amount paid. Proceeding to make said refund using the same means of payment used by the client for the initial transaction.
  The activity is not cancelled due to rain. Only in cases of strong wind or rough sea conditions. In the event that once the activity has started the conditions change and the activity has to be shortened, there will be no right to postpone it or to a refund of the amount paid.
• In order to participate in the activities, the client must inform about any physical, mental and sensory disabilities. They also agree not to be under the influence of alcohol, drugs and/or narcotics, as well as any other medication that may affect their ability to react. In order to participate in the activities, it is essential to know how to swim. The technical sheet for each activity specifies the conditions and minimum ages necessary to participate. Minors must have legal authorization or be accompanied by a responsible person.
• ALOKAYAK’s commitment begins with the contracted activity, so it is the client’s responsibility to transport him/herself to the facilities or to the starting point of the activity, if applicable. Alokayak ‘s contract and responsibility affects exclusively the direct work of its technicians and the organization of the activity. Any actions that participants carry out on their own during rest, waiting, eating, etc. periods are excluded.
• Services not included will be those not indicated in the included section.
• The price includes the necessary equipment, both individual and collective. Each technical sheet specifies the equipment required for each activity.
• The client authorizes ALOKAYAK to use photographs taken during the activity for internal and external purposes, including their use in promotional material and advertising activities, and may be used in publications on any physical, digital or audiovisual channel. Any of the attendees may exercise their explicit right to object, regardless of the purpose of the data request .
• In the event that ALOKAYAK provides equipment for the activity, you agree to use it in accordance with the instructions provided and at your own risk. You will assume responsibility for any damage or loss caused to the equipment due to misuse or negligence on your part.
• You agree to follow the instructions of the Alokayak technicians/instructors at all times , both in the operation of the activity and in the use of the technical material.

RENTAL

1. ALL USERS KNOW HOW TO SWIM and will wear the VEST during the activity.
2. The client must use the kayak/SUP in the unmarked area of the bay (outside the bathing area), without being able to move it to other areas or leave the bay.
3. The number of seats on the boat cannot be exceeded.
4. The client agrees to return the kayak/SUP and accessories in the same condition as received, except for wear and tear from normal operation. The client will be responsible for the repair costs of the canoe or equipment in the event of damage caused by incorrect use of the same.
5. Any rental material that is not returned, whether due to loss, theft, robbery or any other cause that renders it unusable, will be considered as the sale of new material and will be billed to the lessee at market price.
6. The rental service of material and equipment is not covered by the assistance insurance. The use of the equipment is not permitted for persons under the influence of alcohol, drugs or other substances. The company will not have any civil, administrative or criminal liability for failure to comply with the above.
7. In the event that once the rental has started the activity has to be shortened due to causes beyond the control of aloKAYAK ( weather conditions , etc.) there will be no right to postpone it or to a refund of the amount paid.
8. The client expressly agrees to pay aloKAYAK the amount of all types of fines, judicial and extrajudicial expenses arising from improper use, violations and all types of regulations that are directed against the rented equipment.
9. aloKAYAK reserves the right to suspend the service for non-compliance with these rules or for any other justified cause, as well as to demand from the client, if applicable, the corresponding compensation for damages that may be attributable to the client.
10. The client releases aloKAYAK from all liability for loss or damage to objects left, stored or transported in the rented equipment.
11. If the contracted rental time is exceeded, charges will be made in half-hour fractions.
12. The client agrees to comply with the guidelines of Maritime Rescue and Lifeguards.
13. Before renting, it is mandatory to sign this document, accepting the conditions and indicating that they have been read and understood, by name and ID number, passport or other identification document.
14. ALOKAYAK is not responsible for items stored in the warehouse while the activity is taking place.
15. Minors under 16 years of age must be accompanied by an adult of legal age who will be responsible for the minor.
16. The person in whose name the reservation is made will be responsible for the rented equipment.
17. The client knows and assumes that there is an inherent risk in the activity and by carrying it out, the client exonerates the lessor from liability.
     

INSURANCES

The price of the guided services includes an Assistance Insurance with the usual coverage in case of accidents. The rental services of material and equipment (without a guide ) are not covered by the assistance insurance. The Accident Insurance does not cover those over 75 years of age.

Likewise, ALOKAYAK has the corresponding Civil Liability Policy with the coverage required by the regulations of the sector.

Full information on insurance conditions and coverage is available to the customer and will be sent to anyone who requests it.

CANCELLATION POLICY

1. Cancellation due to weather conditions:
   In the event of adverse weather conditions, ALOKAYAK may reschedule or cancel the activity. In that case, the client has the right to rescheduling or a full refund.
2. Cancellation by the customer:

GROUPS UP TO 15 PEOPLE

• 7 or more days before arrival, the total amount paid for the reservation will be refunded.
• Between 7 days and 48 hours, 50% of the total amount or the cost corresponding to the cancelled places will be charged as management fees.
• Less than 48 hours later, 100% of the total amount of the reservation or the cost corresponding to the cancelled places will be charged as management fees .

If the client does not show up on the established date and time, he/she will have to pay the total amount of the reservation.

GROUPS OF MORE THAN 15 PEOPLE

• Between 1 month and 15 days before the reservation, 10% of the total amount or the cost corresponding to the cancelled places will be charged as management fees.
• Between 15 and 5 days before the reservation, 20% of the total amount or the cost corresponding to the cancelled places will be charged as management fees.
• Between 5 and 2 days before the reservation, 50% of the total amount or the cost corresponding to the cancelled places will be charged as management fees.
• Less than 48 hours later, 100% of the total amount of the reservation or the cost corresponding to the cancelled places will be charged as management fees.

If the client does not show up on the established date and time, he/she will have to pay the total amount of the reservation.

In the event of cancellation for JUSTIFIED medical reasons or death of any relative, ALOKAYAK will offer a voucher valid during the current season for the performance of the contracted activity. If you choose to cancel the reservation, the conditions described above will apply.

It is essential that you have fully understood all the explanations and guidance provided before and during the activity. If you have any questions or require further information, please do not hesitate to ask for clarification before starting the activity.

By paying for a rental or tour, it is understood that the client has read and accepted our terms and conditions. In addition, when booking on our website, you will be asked to confirm your acceptance before completing your reservation. 

ALOKAYAK reserves the right to modify these General Conditions at any time, without prior notice to the CUSTOMER, who in any case is responsible for reviewing them as a prerequisite to acquiring the service available through this Website. In any case, the General Conditions that were posted on the Website at the time the CUSTOMER acquired the corresponding service will be considered valid and applicable.

From the moment the reservation is confirmed, the client expressly accepts all of these General Conditions. In the event that a person reserves for another person/people, he/she accepts all and each of these Conditions in his/her/their name/s.

DATA PROTECTION

We inform you that ALOKAYAK stores your personal and contact data to answer your requests for information and to inform you of our activities and services, in accordance with our privacy and cookies policy. You can exercise your rights of access, rectification, cancellation and opposition by sending a request accompanied by a photocopy of your ID, using the web form or by email to info@alokayak.com.
